SI derecho disciplinario, dada su naturaleza punitiva, le son aplicables los principios y garantías del derecho penal13, lo que se traduce en que los servidores públicos no puedan ser sancionados por cargos que no les fueron formulados14, porque quien no tiene un conocimiento real, efectivo y completo de las acusaciones en su contra no puede controvertirlas, de modo que resulta claro que los servidores judiciales no pueden ser condenados por cargos de los que no fueron noticiados con antelación a la sentencia, tanto así que el inciso final del artículo 165 de la Ley 734 de 20021
