La garantía efectiva del derecho a un debido proceso sin dilaciones indebidas, implica, en principio, la diligente observancia de los términos procesales, sin perjuicio de las sanciones que se generen por su incumplimiento. De esta manera, un proceso sin dilaciones injustificadas debe entenderse como aquél trámite que se desenvuelve en condiciones de normalidad dentro de los plazos perentorios fijados por el legislador y en el que los intereses litigiosos reciben pronta satisfacción. En síntesis, si bien la administración de justicia debe ser pronta, no todo retardo genera una afectación del derecho a un proceso sin dilaciones, puesto que debe suscitarse un incumplimiento de los términos procesales que tenga un origen Injustificado, es decir, producto de la falta de diligencia de quien administra justicia en el cumplimiento de su función.
