Al señalar el inciso tercero del artículo 25 de la ley 734 de 202 que "para efectos de esta ley y en concordancia con el artículo 38 de la ley 489 de 1998, son servidores públicos disciplinables, los gerentes de cooperativas, fundaciones, corporaciones y asociaciones que se creen u organicen por el Estado o con su participación mayoritaria", no se vulnera el derecho a la igualdad alegado por la demandante. Por el contrario, además de ser función del legislador establecer las categorías de servidores públicos, según el tipo de responsabilidad al que se encuentran sometidos, debe entenderse que los sujetos no incluidos en la norma, en razón a su inferior jerarquía, estarán sometidos al derecho privado.
