La presunción de inocencia de quien está siendo investigado por una autoridad estatal, es una de las garantías constitucionales del derecho fundamental al debido proceso, así pues, las dudas razonables se deben resolver en favor del investigado ya que no fue posible desvirtuar la presunción de inocencia, porque no se logró llegar a una convicción racional de la responsabilidad, desprovista de dudas razonables, es decir, aquellas que objetivamente surjan del análisis y cotejo de las pruebas obrantes en el expediente.
