La función de configurar el diseño y la estructura al servicio público en salud le fue atribuida al Congreso. Esta reserva de ley tiene especial significado dado que la salud es un derecho constitucional, el cual ha sido calificado por la Corte como fundamental. Lo anterior no significa que todas las leyes sobre la salud deban ser estatutarias, sino que aún las decisiones sobre la organización del sistema de salud y la configuración de los organismos que lo integran deben ser adoptadas mediante leyes después de un proceso de deliberación democrática y pluralista.
