La Corte Constitucional declara la exequibilidad de la expresión “y podrá ser reelegido por una sola vez” contenida en el articulo 1 de la Ley 1263 de 2008 que modifico el artículo 28 de la Ley 99 de 1993 fundamentando la decision al indicar que la limitación de la reelección de funcionarios para una sola vez, (i) constituye una medida de probidad de la función pública; (ii) garantiza la participación y acceso en igualdad de condiciones a los cargos públicos; (iii) se erige en un mecanismo de control al poder político, y (iv) en algunos casos, asegura el diseño institucional del Estado
