La inclusión en el RUV es un derecho fundamental de las víctimas del conflicto armado. Para ello, la UARIV debe adelantar un procedimiento en que valore la declaración realizada y los elementos de prueba aportados con ésta de conformidad con los criterios técnicos, jurídicos y de contexto a que haya lugar. En el desarrollo de esto, la entidad está obligada a acudir a todos los medios de información y bases de datos que hacen parte de la Red Nacional de Información, como quiera que la carga de la prueba se invierte y, en ese sentido, corresponde al Estado demostrar que la persona no tiene la calidad de víctima para efectos de la Ley 1448 de 2011.
