El fuero sindical es (i) una garantía constitucional para hacer efectivo el derecho a la libre asociación sindical y para proteger la libertad de acción de los sindicatos. (ii) el fuero cobija a ciertos trabajadores que pertenecen a una organización sindical, quienes tendrán una serie de garantías laborales (prohibición de despido, desmejoramiento de condiciones y traslado a otro lugar de trabajo, a menos que exista una justa causa y autorización judicial). Y (iii), el fuero sindical hace posible que los líderes de los sindicatos lleven a cabo sus tareas en beneficio de los trabajadores, sin temer las eventuales represalias del empleador. El fuero sindical no significa, entonces, la imposibilidad de despedir al trabajador aforado, sino que al hacerlo, el empleador debe demostrar una justa causa y solicitar la autorización al juez quien deberá verificar su existencia
