El objeto de la acción de cumplimiento es hacer efectivos la ley o el acto administrativo. Por lo tanto, el legislador no estaba obligado a configurar una acción de cumplimiento cuyo objeto cobijara la pretensión de indemnización de perjuicios. La naturaleza de la acción de cumplimiento la aleja de aquellas que se revisten de un carácter declarativo de derechos. Lo que el constituyente quiso fue establecer un mecanismo para hacer efectivos mandatos o derechos expresamente consagrados en la ley o en el acto administrativo anterior, sobre los cuales no existe discusión o incertidumbre
