Corte constitucional declara inexequible el numeral 22.2 del artículo 22 del Decreto Ley 775 de 2005, el cual establece como principios rectores del sistema de carrera en las Superintendencias el Concurso Abierto el cual deberá efectuarse sin discriminación de ninguna índole. Ahora bien, al establecer la norma demandada, como uno de los aspectos de evaluación, la experiencia relacionada directamente con las funciones del cargo y la evaluación del desempeño. Sin dudas, se está tomando como parámetro de evaluación una medida discriminatoria con aquellos ciudadanos que no pertenecen a la carrera administrativa o que perteneciendo a ella no han desempeñado el cargo a proveer.
