El Constituyente de 1991 reguló la transformación del Banco de la República en el eje de un sistema de banca central. De ahí que entre las más importantes innovaciones de la nueva Carta Política figura la de haber elevado al Banco de la República a la categoría de órgano del Estado con rango constitucional, concebido como persona jurídica de derecho público económico, con autonomía patrimonial, técnica y administrativa, sujeta a un régimen especial, con el propósito primordial de ejercer las funciones de banca central.
