Con la penalización de conductas indebidas de servidores públicos en la celebración de contratos estatales, el legislador no ha invadido competencias exclusivas de la jurisdicción contenciosa administrativa, por el contrario, ha previsto en el Código Penal y de Procedimiento Penal Colombianos, la forma como debe actuar el fiscal o el juez penal cuando está pendiente una decisión judicial al respecto.
