La Corte que tratándose del instituto jurídico de la casación en materia penal la jurisprudencia constitucional ha expresado que no constituye una acción independiente del proceso, sino, todo lo contrario, un medio extraordinario de impugnación llamado a cumplir las finalidades constitucionales de la prevalencia del Estado Social de Derecho, el imperio de la ley, la realización del derecho sustancial y la unificación de la jurisprudencia nacional, según se desprende de lo preceptuado en el artículo 235-1 de la Carta Política.
