El tratamiento específico que la Ley 640 de 2001 otorga a la acción de repetición se justifica en la medida en que el Estado no puede abstenerse de promover el procedimiento judicial respectivo. Esta obligatoriedad en la iniciación de la acción conduce a que se exonere al Estado de la obligación de celebrar audiencia de conciliación previa a la presentación de la demanda, como una medida tendiente a aligerar su carga procesal. Así la disposición busca hacer menos onerosa la carga procesal del Estado en el trámite de reparación del patrimonio público afectado por la conducta de uno de sus agentes.
