Caducidad de la acción, demanda de inconstitucionalidad parcial en contra del numeral 9 del artículo 136 del Código Contencioso Administrativo, modificado por el artículo 44 de la Ley 446 de 1998. Si la entidad condenada, desborda los límites de tiempo señalado para el pago de las condenas, ello no puede afectar el derecho al debido proceso del servidor presuntamente responsable, razón por la cual, la norma será declarada exequible bajo el entendido de que el término de caducidad de la acción empieza a correr, a partir de la fecha en que efectivamente se realice el pago, o, a más tardar, desde el vencimiento del plazo de 18 meses previsto en el artículo 177 inciso 4 del Código Contencioso Administrativo.
