Corte Constitucional declara exequible el artículo 38 de la Ley 734 de 2002 La inhabilidad que ocurre como consecuencia de haberse interpuesto la tercera sanción disciplinaria en cinco años surge, no como una nueva sanción, sino como una medida de protección de la Administración, que pretende evitar el acceso a sus cargos de personas que han demostrado una manifiesta incompetencia en el manejo de los negocios que se les encomiendan
