REGIMEN DISCIPLINARIO DEL ABOGADO

En la Ley 1123 de 2007, el legislador adoptó un mecanismo de aplicación del nuevo procedimiento destinado a la investigación y juzgamiento de conductas consideradas como faltas disciplinarias de los abogados. A partir del mismo, dispuso la aplicación inmediata de la nueva norma para los procesos que no se hubieran iniciado por no haberse proferido auto de apertura de la investigación, mientras que preservó la vigencia de la anterior, para los procesos que ya venían siendo adelantados.¿ La ley 1123 de 2007 en algunas de sus disposiciones desarrolla el principio de aplicación general e inmediata de la ley procesal, contemplado en los artículos 40 y 43 de la Ley 153 de 1887, que no resulta contrario a la Constitución siempre que se garantice el principio de favorabilidad
