La norma general en materia de vinculación a la administración pública es el régimen de carrera administrativa, respecto del cual se admiten las excepciones contempladas en la misma Constitución y las autorizadas por el legislador. La ley no puede establecer como norma general el régimen de libre nombramiento y remoción, sólo puede, en casos particulares, indicar el régimen contrario justificado por la naturaleza de las funciones específicas correspondientes al cargo. En principio no puede admitirse, de manera general, que el cargo de asesor en los niveles territoriales sea de libre nombramiento y remoción.
