Con la consagración de la querella se pretende proteger algunos derechos de los sujetos pasivos del delito, tales como la intimidad personal y familiar, la autonomía personal y la honra del afectado. En aquellos casos en los que la investigación penal puede afectar o poner en riesgo los derechos de las víctimas, el Estado deja en sus manos la decisión de poner o no en funcionamiento el aparato investigador y sancionador del Estado. Dicho en otros términos, la querella surge como un mecanismo de conciliación de derechos que pueden encontrarse en tensión con ocasión del delito, puesto que al consagrar la querella como requisito de procedibilidad de la acción penal, el legislador parte de la magnitud de los delitos en consideración.
