La ley habilitante facultó al Gobierno para aumentar y disminuir la planta de personal de empleados de la Rama Jurisdiccional, pero sobre la base del respeto a las nuevas modalidades del servicio y observando los procedimientos y criterios que rigen el nombramiento de empleados y funcionarios de la misma. Dentro de la lista de excepciones de cargos de carrera no se encuentra los Auxiliares Judiciales de Magistrado de los Tribunales Administrativos, por lo que forzosamente están comprendidos dentro del régimen aplicable a los funcionarios de carrera y excluidos del régimen de libre nombramiento y remoción.
